More than how much money owed one may be prohibited from emigration? How should one apply for release from emigration restriction?
1. If an obligor has one of the behaviors listed on Administrative Enforcement Law, Article 17, Item 1, the Administrative Enforcement Branch may order the obligor to provide substantial collaterals, pay up owed money before deadline and restrict one’s resident(emigration), which depends on whatever money owed. These behaviors include one (a) affords to perform obligation apparently but not willing to do it, (b) may hide or run away, (c) may hide or transfer property that is the subject of execution, (d) denies to provide information about executable property to executor, (e) gives no or fake report when ordered to present property owned, (f) does not show up with reason after legal notification. 2. One may apply to Administrative Enforcement Branch for abolishing emigration restriction after he/she pays all owed money or provide collaterals.

Do I need to come in person for application of payment in installments?
If you cannot come in person due to certain reason, you may entrust an attorney to the Branch for transaction. Please ask the agent to carry the power of attorney, identity certificate as well as the cash for the first installment.

My vehicle has already reported obsolete, why I still receive notification paper that I owe license plate tax?
Our agency is only responsible for execution procedural examination. As for issues of disputable conduct of imposing license plate tax, we kindly request obligators to check them at transferring departments.

The company of my own received execution order that requires the company to deduct my staff’s salary. Could I just neglect the order?
An obligor, working in a company, has the right to request salary from the company, and this right belongs to other property rights, according to Administrative Enforcement Law. If the company has a reason not to follow the order, it may file a complain, based on law. If the company neither file a complain nor perform salary deduction order, our branch may execute the company’s property if transferring bureau requests it. Besides, your company may also violate laws.

When transferring bureau’s notification was delivered to my home, I was not at home and my fourteen-year-old son received it but not relay it to me. Is such delivery from transferring department valid?
If your fourteen-year-old son has normal understanding and handling ability for day-to-day affairs, the delivery is valid, even if he did not relay the mail to you.

All companies limited by shares have their respective board chairman as the legal representative, so why the Branch still notices directors for report of financial status?
nt to Article 8 of the Company Act: directors are still “representatives” of the company, so the notice of the Branch is based on the law.

I’ve received notice of owing license plate tax, but the obligor had died. He lent his identity card to others to apply license, but the borrower did not report the plate obsolete. How should this be handled?
Please mail or fax death certificate to the section that is responsible for this case, the section will handle it properly based on regulation.

I did not pay health insurance premium for two months after completing military service, but received an execution decree that shows I owe around 20,000. Why such a huge amount?
Administrative Enforcement Branch can only make enforcement based on execution reasons, which indicate how much amount owed from transferring department. If the amount is regarded mistaken, please contact Central Health Insurance Bureau.

Administrative Enforcement Agency can obtain information about bank accounts of obligors in all kinds of financial institution. Why it cannot contact obligors by sending mails to their current residential address.
Unless obligors report current residential address by themselves, Administrative Enforcement Agency can only send delivery to obligators’ registered addresses, business places and working places. If delivery cannot reach the mentioned places above, Administrative Enforcement Agency can choose public delivery, according to Administrative Enforcement law article 78.

After installation payment is permitted, how should I handle subsequent procedure? After completion of installation payment application, if payment is not handed in on time, what are the legislative consequences?
According to Administrative Execution with Installation Payment Act article 5, point 1, obligors or third party should establish guarantee document, provide substantial warranty, or hand in guarantee certificate to institutions’representatives. Meanwhile, transferring departments should issue receipts to obligors and executors. After completion of application procedure, if obligors pay insufficient amount or not pay on time, Administrative Enforcement Agency may abandon the installation payment agreement, due to Administrative Execution with Installation Payment Act article 5, point 2.
