What is “Administrative Execution”？
1、According to Article 2 of Administrative Execution Act, the administrative enforcement comprises of “compulsory execution on obligatory payment under public law”, compulsory execution on obligation of action or non-action” and “immediate coercion”. 2、All branches subordinated to the Administrative Agency handle matters regarding “compulsory execution on the obligatory payment under public law”.

The company of my own received execution order that requires the company to deduct my staff’s salary. Could I just neglect the order?
An obligor, working in a company, has the right to request salary from the company, and this right belongs to other property rights, according to Administrative Enforcement Law. If the company has a reason not to follow the order, it may file a complain, based on law. If the company neither file a complain nor perform salary deduction order, our branch may execute the company’s property if transferring bureau requests it. Besides, your company may also violate laws.

Recently there are fraud companies delivering fake payment notification document under the name of Administrative Enforcement Branch. How should people verify the authenticity of these documents?
Here’s some tips: 1. Easy judgment: recipients of payment notification documents must be one of the Administrative Enforcement Agencies. If the recipient of payment notification document is under some individual’s or companys name, the document must be a fake one. 2. When receiving payment notification document, please call directly to 104 for the telephone number of our agencies and consult our executor for the existence of such a case and other related information. 3. For any notification document issued by Administrative Enforcement Agencies, the title read “法務部行政執行署○○分署”from left to right and with a red official stamp. 4. There are transferring case number below the title, execution case number and reason in upper part of the document, execution officer’s name in right-lower part of the document, recording officer’s name and stamp in left-lower part of the document, contact information such as address, phone number and fax number in the middle of the document. 5. Execution amount is listed under “Amount to pay,” and “Transferring department” lists the name, address, phone number and case number, which can be used for obtaining details of a case. 6. If a fraudulent notification document is spotted, please report to any of our branches by designated phone or fax. Thank you.

Obligators sometimes come to the agency and ask about where some income, leading to unpaid income tax, comes from. Our officer usually show them supplementary document that recorded when and where the income is reported, but obligators deny such incomes and allege the income reports are usurped by other people. Things like this happen a lot and disturb our execution staff very much.
Administrative Enforcement Branch is an execution office that possesses no right to judge validation of administrative punishment and can only execute based on recorded reason of execution. If obligators think there are mistakes about obligators or amount, please check directly at transferring department.

My vehicle has already reported obsolete, why I still receive notification paper that I owe license plate tax?
Our agency is only responsible for execution procedural examination. As for issues of disputable conduct of imposing license plate tax, we kindly request obligators to check them at transferring departments.

Administrative Enforcement Agency can obtain information about bank accounts of obligors in all kinds of financial institution. Why it cannot contact obligors by sending mails to their current residential address.
Unless obligors report current residential address by themselves, Administrative Enforcement Agency can only send delivery to obligators’ registered addresses, business places and working places. If delivery cannot reach the mentioned places above, Administrative Enforcement Agency can choose public delivery, according to Administrative Enforcement law article 78.

I did not pay health insurance premium for two months after completing military service, but received an execution decree that shows I owe around 20,000. Why such a huge amount?
Administrative Enforcement Branch can only make enforcement based on execution reasons, which indicate how much amount owed from transferring department. If the amount is regarded mistaken, please contact Central Health Insurance Bureau.

When transferring bureau’s notification was delivered to my home, I was not at home and my fourteen-year-old son received it but not relay it to me. Is such delivery from transferring department valid?
If your fourteen-year-old son has normal understanding and handling ability for day-to-day affairs, the delivery is valid, even if he did not relay the mail to you.

I’m a temporary employee and be paid not much. But I had been noticed that I have some tax not paid by Administrative Enforcement Branch. I think it must be a mistake, and maybe it’s not authentic. And I wonder how to know the truth?
You can call to the Administrative Enforcement Branch to ask the clerk to check it. We can tell you that which bureau transferred your case. We don’t have the right to correct the amount of fine or abandon the case. If you have other questions, please contact the bureau for further resolution.

After installation payment is permitted, how should I handle subsequent procedure? After completion of installation payment application, if payment is not handed in on time, what are the legislative consequences?
According to Administrative Execution with Installation Payment Act article 5, point 1, obligors or third party should establish guarantee document, provide substantial warranty, or hand in guarantee certificate to institutions’representatives. Meanwhile, transferring departments should issue receipts to obligors and executors. After completion of application procedure, if obligors pay insufficient amount or not pay on time, Administrative Enforcement Agency may abandon the installation payment agreement, due to Administrative Execution with Installation Payment Act article 5, point 2.
